Personal Property Securities Act under Review

It's been nearly 3 years since the PPSA and its Register came into operation, heralding a paradigm shift in the treatment of security interests in personal property. With the transitional 'grace' period for pre-PPSA arrangements ending earlier this year , the full impact is now being felt, particularly on smaller businesses and in insolvency cases, and the first few cases are trickling through the Australian courts. Alongside that, there has been specific amendment to the scope of PPS Leases and motor vehicles proposed in the Deregulatory Measures Bill, and the scheduled Government review of the Act's operation is under way, due to be completed by January 2015.

This presentation will focus on likely areas for amendment in the review, the impact of the amendments, and issues emerging in the early Australian cases. Where relevant, there will be reference to key developments in Canada and New Zealand.

Presenter: Associate Professor David Brown

Associate Professor David Brown teaches and researches secured transactions law and has taught about the PPSA at undergraduate and postgraduate levels, in New Zealand, Canada and Australia. He is co-author of Duggan and Brown, Australian Personal Property Securities Law (LexisNexis 2013) and as well as being on the Law Council's Business Law working group on the Government's Review of the PPSA, he has advised in litigation in this area in Australia and New Zealand, and frequently presented to professional organisations.
